§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed by customers via the online shop *Jeweldealer*. The operator of the online shop is:

(2) Any terms and conditions of the customer that deviate from these will not be recognized unless the supplier expressly agrees to their validity in writing.

§ 2 Conclusion of Contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.
(2) By clicking the "Buy" button, the customer submits a binding offer to conclude a purchase agreement.
(3) The supplier accepts the order by sending a confirmation email or by dispatching the goods.

§ 3 Prices and Payment Terms
(1) All prices are exclusive of VAT and shipping costs.
(2) The available payment methods are listed in the online shop and include, for example, bank transfer, credit card and PayPal.

§ 4 Delivery and Shipping
(1) Delivery shall be made to the delivery address specified by the customer.
(2) Unless otherwise stated, the delivery time is approximately 2-5 days.
(3) If a product is unavailable, the customer will be informed immediately and any payments already made will be refunded.

§ 5 Right of withdrawal
(1) Customers who are consumers within the meaning of Section 13 of the German Civil Code (BGB) have a right of withdrawal in accordance with the statutory provisions.
(2) Cancellation policy:
- Cancellation period: The customer can cancel the contract within 14 days without giving any reason.
- Cancellation procedure: The cancellation must be made in writing (e.g. by email or letter) before return shipment and will be checked by the contractor before return shipment in order to avoid excess shipping costs by the client.

(3) Consequences of cancellation: In the event of cancellation, all payments (including the cheapest delivery option) will be refunded. The customer bears the return shipping costs.

(4) Exclusion of the right of withdrawal for sealed products: In the case of contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or durability, the right of withdrawal shall be excluded if the seal has been removed or damaged after delivery.
This is especially true for Silver Clay, as it dries out after opening and thus becomes unusable.
Customers are explicitly informed before purchase that there is no right of withdrawal for opened or unsealed Silver Clay.

§ 6 Retention of Title
The goods remain the property of the supplier until full payment has been received.

§ 7 Warranty
The statutory warranty rights apply.

§ 8 Liability
(1) The provider shall be fully liable for damages resulting from an intentional or grossly negligent breach of duty.
(2) The provider shall only be liable for slightly negligent breaches of duty if essential contractual obligations are breached.
(3) We do not provide any warranty for third-party products. Any claims for defects must be addressed to the respective manufacturer. Our warranty obligations remain unaffected.

(4) Liability for improper application, unauthorized modifications or misuse of the products is excluded.

Section 9 Data Protection
Personal data is processed in accordance with the privacy policy, which can be viewed in the online shop.

§ 10 Final Provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these General Terms and Conditions be invalid, the remainder of the contract shall remain in effect.
